Terms of Service

These Terms of Service (“Terms”) govern your use of the StayLoyal mobile application (“App”) operated by StayLoyal (“we,” “us,” or “our”). By using the App, you agree to these Terms.
1. Service Description
StayLoyal is a digital loyalty rewards platform that connects consumers with local businesses. Consumers earn points or stamps by submitting receipt photos from participating businesses and can redeem accumulated rewards. Business owners manage their loyalty programs, review receipt submissions, and engage with customers through the platform.
2. Eligibility
You must be at least 13 years of age to use the App. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Receipt Submission Rules
When submitting receipts, you agree to the following:
- All receipts must be authentic and unaltered originals from the participating business
- Each receipt may only be submitted once; duplicate submissions are prohibited
- Receipts must reflect genuine purchases you personally made
- The amount and date you enter must accurately match the receipt
- Receipts from other businesses may not be submitted to a different business
- You may submit a maximum of 10 receipts per day across all businesses
- Receipt photos must be clear and legible with the date and total visible
We use optical character recognition (OCR) technology to verify receipt details. Discrepancies between your reported values and OCR-detected values may be flagged for manual review.
5. Loyalty Points and Stamps
Points and stamps are awarded at the discretion of participating businesses based on their loyalty program rules. Points and stamps:
- Have no cash value and cannot be exchanged for currency
- Are non-transferable between users
- May be subject to expiration as set by the business
- May be revoked if earned through fraudulent activity
- Are specific to each business and cannot be combined across businesses
- Points accumulate fractionally but are displayed as whole numbers; only whole points may be redeemed
6. Reward Redemption
When redeeming rewards:
- Redemption codes are valid for 10 minutes from generation
- You must present the redemption code to business staff for confirmation
- Once a reward is redeemed and confirmed, the corresponding points or stamps are deducted and cannot be restored
- Rewards are non-transferable and may not be resold
- A cooldown period of 1 hour applies between redemptions of the same reward
- Businesses reserve the right to verify your identity during redemption
7. Business Responsibilities
Participating businesses are responsible for:
- Setting fair and transparent loyalty program terms
- Reviewing and processing receipt submissions in a timely manner
- Honoring valid reward redemptions
- Providing accurate business information
StayLoyal is a platform facilitating loyalty programs and is not responsible for the products, services, or practices of participating businesses.
8. Prohibited Conduct
You agree not to:
- Submit fake, altered, or fraudulent receipts
- Create multiple accounts to circumvent limits or restrictions
- Use automated tools, bots, or scripts to interact with the App
- Attempt to exploit bugs or vulnerabilities in the platform
- Impersonate another user or business
- Interfere with the operation of the App or other users' experience
- Reverse-engineer or decompile the App
9. Account Termination
We reserve the right to suspend or permanently terminate your account, without prior notice, for:
- Submitting fraudulent receipts
- Violating any of these Terms
- Engaging in any activity that harms the platform or its users
- Repeated violations of receipt submission rules
Upon termination, all accumulated points, stamps, and unredeemed rewards are forfeited. You may voluntarily delete your account at any time through the App or by contacting support.
10. Limitation of Liability
To the fullest extent permitted by law:
- StayLoyal is provided “as is” without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App
- Our total liability shall not exceed the amount you paid to use the App (which is $0 for free accounts)
- We are not responsible for the actions, products, or services of participating businesses
- We are not liable for loss of points, stamps, or rewards due to account termination for cause
11. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be addressed through good-faith negotiation by contacting us at support@stayloyal.io. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitrations are not permitted.
12. Modifications
We may modify these Terms at any time. Material changes will be communicated through the App or by email at least 14 days before taking effect. Continued use of the App after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws of the United States. Any legal proceedings shall be conducted in English.
